Shipping Policy - the basics

**5buckcigars.com** ("we," "us," or "our") is committed to compliant, secure, and timely delivery of your premium cigars and related products. All shipments comply with federal, state, and local laws governing tobacco products, including age restrictions, tax obligations, and delivery requirements. By placing an order, you agree to this Shipping Policy and confirm you are at least 21 years of age.

 

**1. Where We Ship**  

We ship **only within the continental United States** (lower 48 states) to residential or business addresses where permitted by law. We do **not** ship to:  

- Hawaii, Utah, or any other states/jurisdictions that prohibit or restrict direct-to-consumer shipments of premium cigars/tobacco products (list subject to change; current common restrictions include Hawaii, Utah, and certain flavor/shipment bans in Maine, Maryland, Massachusetts, etc.).  

- international destinations.  

- Any address where local laws prohibit receipt of tobacco products.  

 

We reserve the right to refuse, cancel, or not ship to any location for compliance reasons. Orders to restricted areas will be canceled with a full refund (minus any processing fees).

 

**2. Shipping Methods and Carriers**  

We use reliable carriers (e.g., **UPS**, **USPS**, or others as appropriate) that support adult-signature tobacco shipments.  

- **Adult Signature Required (21+)**: All shipments require signature by an adult 21 years or older upon delivery, per federal and state law. Carriers will not release packages without proper age verification.  

- **Photo ID Verification**: The recipient may need to present government-issued photo ID if appearing under 30 (or as required by carrier/law).  

- **Shipping Options**: [Customize based on your setup, e.g.]  

  - Standard Ground: 3–7 business days (estimates only).  

  - 2-Day / Express: Faster options available at checkout (additional fees).  

  Delivery times are estimates and not guaranteed. Delays may occur due to weather, carrier issues, holidays, or verification holds.

 

**3. Order Processing and Cutoff Times**  

- Orders placed before [e.g., 2:30 PM EST], Monday–Friday (excluding holidays), typically ship the same business day.  

- Orders after cutoff or on weekends/holidays ship the next business day.  

- We process orders only after successful age verification and payment clearance.

 

**4. Age Verification and Compliance with Delivery Sales Laws**  

We strictly enforce federal and state requirements for delivery sales of tobacco products (including Florida Statute § 210.095 and similar laws):  

- You must be 21+ to order; we use third-party age-verification services at checkout.  

- We obtain certification of age (21+), verify via commercially available databases or government ID, and may request additional proof.  

- Shipments include required notices on packages/documents (e.g., “Tobacco Products: [State] law prohibits shipping to individuals under 21 and requires payment of all applicable taxes”).  

- We collect/remit applicable sales, excise, and use taxes where required.  

- Records are maintained as mandated by law.  

 

You agree to provide accurate information and ensure a 21+ adult is available to sign for/accept delivery. We are not liable for failed deliveries, returns due to non-verification, or seizures by authorities.

 

**5. Shipping Charges and Taxes**  

- Rates calculated at checkout based on weight, destination, and method.  

- Prices exclude shipping, handling, taxes, duties (if applicable). Taxes added where required by law.  

- Additional fees may apply for oversized/heavy orders or expedited service.

 

**6. Risk of Loss and Insurance**  

Risk of loss passes to you upon handover to the carrier. We may include basic insurance; contact us for claims (damaged/lost packages reported within [e.g., 7 days]).

 

**7. Weather and Perishable Nature**  

Cigars are sensitive to temperature/humidity. We may delay shipments during extreme weather to protect quality (e.g., no shipping in excessive heat/cold without protective packaging). We are not responsible for quality issues due to carrier delays or improper storage post-delivery.

 

**8. Prohibited Conduct**  

Do not order for resale to minors, use false information, or circumvent restrictions. Violations may result in order cancellation, account termination, and reporting to authorities.

 

**9. Changes to Policy**  

We may update this policy; continued orders constitute acceptance.
